1. Limited Warranty
SMARTS Health warrants that the digital monitoring products supplied by SMARTS Health (the “Products”) will materially operate in accordance with the applicable product documentation provided by the manufacturer.
In the event of a verified defect, the sole and exclusive remedy available to the customer shall be the replacement of the defective Product with a substitute product.
No refunds shall be provided unless otherwise required by applicable law.
2. 30-Day Notification Requirement
Customers must notify SMARTS Health in writing of any suspected defect or damage within thirty (30) days of receipt of the Product.
Failure to notify SMARTS Health within this 30-day period shall void eligibility for replacement under this policy.

As a condition of any replacement request, customers agree to participate in reasonable remote troubleshooting procedures.
SMARTS Health (or its authorized partner) may require:

Verification that the Product was used in accordance with provided instructions
If the issue can be resolved through troubleshooting, a replacement will not be issued.
4. Exclusions
This limited warranty does not apply if the Product:

Was used other than in accordance with the provided documentation

Was modified, altered, or tampered with

Was damaged due to misuse, neglect, accident, or improper storage

Was used beyond the permitted usage period (if applicable)

Was transferred or resold to another party
5. Limitation of Warranty
Except as expressly stated above, the Products are provided “as is” and SMARTS Health disclaims all other warranties, express or implied, including but not limited to implied warranties of merchantability or fitness for a particular purpose, to the fullest extent permitted by law.
SMARTS Health shall not be liable for any indirect, incidental, consequential, or special damages arising from the use of the Products.
